TERMS AND CONDITIONS

Please read these Terms and Conditions (hereafter called «Terms») carefully before using the Smart Micro Egg App (hereafter called «Service»), operated by Micro Mobility Systems AG (hereafter called «Micro»).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing, downloading, or using the Service, you acknowledge that you have read, understood and agreed to these Terms. The Smart Micro Egg App may only be used by user above the age of 16 years or with the consent of a guardian. We have taken measures in the app to prevent minors (under age of 16) of registering an account but it is at all times the guardians responsibility to make sure kids don't use the app without supervision. Where you are permitting a minor to use the Service, you are also agreeing that the minor will adhere to the Terms.
If you do not agree to these Terms, you may not access or use the Service. We may update and modify the Terms from time to time. Your continued use of the Service means that you have accepted those modifications.

Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“content”). You are responsible for not changing content in a way that violates current regulations or laws and are expected to respect others in doing so.

Links to other websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Micro. Micro has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Micro shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

User rights and restrictions

These Terms grant permission to you, in your individual capacity, to use the content of Service made available to you for personal, noncommercial home use only. In no instance may you:

Change or remove any copyright and other proprietary notices from content on the Service;
Modify, or create derivative works based on, the content;
Use, or facilitate the use of, any unauthorized third-party software (e.g. bots, mods, hacks, and scripts) to modify or automate operation within the Service whether for yourself or for a third party.
Use the content in any manner: (a) suggesting an association with any other products, services, or brands (b) that is likely to cause confusion among customers, (c) that disparages or discredits Micro, (d) that is otherwise exploitative for any commercial purpose; or (e) that otherwise infringes our intellectual property rights;
Download quantities of content to a database for any reason;
Decompose, disassemble, or reverse engineer any part of any Service, or otherwise use a Service for any purpose other than those provided for by us and in conjunction with the operations of the Service;
Develop functionally similar products or services to the Service;
Use the Service for the benefit of any third party or transfer access to the Services to any third party;
Use the Service or content for commercial purposes, including, but not limited to: (a) selling access to all or part of the Service; or (b) placing advertising, sponsorships, or promotions on or within the Service or content;
Avoid, circumvent, or disable any security or digital rights management protocols or mechanism in the Service;
Infiltrate any system used to operate the Service;
Take any action to cause, or exploit, known or latent malfunctions, bugs or other defects in the Service or system used to operate the Service;
Attempt to circumvent any restriction in the Service based upon age, geography, or other restriction imposed by us.

Furthermore, you will comply with all applicable laws and legal obligations, including those pertaining to such areas as: copyright, trademark and other intellectual property laws, libel, slander, defamation, trade libel, product disparagement, harassment, invasion of privacy, tort, obscenity, indecency, and copyright or trademark infringement. Violations of applicable laws may give rise to civil and/or criminal prosecution and penalties.
You acknowledge and agree that you are solely responsible for maintaining the confidentiality of your account, login ID and password you use in connection with the Service, including by not reusing passwords you have used with the Service for any other account. You agree that Micro will not be responsible for any losses arising out of any unauthorized use of your accounts.
Notwithstanding anything to the contrary included in these Terms, we may at any time, with or without notice, suspend or terminate your access to some or all of the Service and refuse any and all current or future use of the Service at any time.

Conduct and community standards

You are prohibited from posting or transmitting any material to the Service that could: (i) interfere with anyone else's use of the Service; (ii) be considered abusive, illegal, indecent, obscene, offensive, or threatening in any way; (iii) encourage anyone to break the law; (iv) violate anyone's copyright or other property right; (v) interfere with the privacy of any other user; (vi) contain a virus or any other harmful component; or (vii) contain false or misleading statements of fact or descriptions of the origin of the material or the communication.
We may change, edit, or remove any user material or conversations that we deem illegal, indecent, obscene, offensive, or otherwise violating our policies in any way. We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone posting such materials.

Updates and changes to the Service

We may, from time to time, issue patches or updates for portions of the Service which must be installed to continue using those portions of the Service. You consent to receive and install those patches and updates in order to continue using the Service. You also accept that all or portions of the Service may experience server issues that make it temporarily unavailable, and that we may in our sole discretion and without notice terminate all or any part of the Service. You accept that you will have no recourse of any kind against us even if this causes you to lose a match, to lose Virtual Content, or to have no further access to all or part of the Service.

Handling of our products

We offer products that work together with the Service containing advanced electronics and batteries. Broken or damaged products should not be used. Micro assumes no legal responsibility if a broken or damaged product is used in violation with these Terms. Batteries from broken products should be kept away from children, pets and others who might risk breaking, consuming them or in other ways be put at risk.

Questions and contact

If you would like to: access, correct, amend or delete any personal information we have about you, you are invited to contact us at support-smartegg@micro.ms. As a guardian you can also delete the account yourself. To do so, go to "Settings" in the parental mode in the app and follow the instructions.

PRIVACY POLICY

Micro respects your privacy rights and recognizes the importance of protecting your personal information (or “personal data”). Our Privacy Policy describes the kinds of personal information we collect, why we collect it, how we share it, and choices we give you.

What personal information is collected about you:

We collect information you provide us, including:

Contact information: your email address and your age.
Content and files: data and content you share or upload, such as photos (including any metadata included in your photos and content).
Demographic information: information about you tied to your personal information, such as your date of birth and country/region of residence.
Details you provide in response to surveys about our products
Information you provide when seeking help from us such as your name, telephone number and records of the issues you experience.

We collect other information automatically when you use our Service, including:

Identifiers and device information: such as your device type, operating system type, browser type, device ID, Internet Protocol (IP) address, and other software including type, version, language, settings, and configuration.
Usage data: such as what website you were on that brought you to our website, when you used our Service and for how long, what pages and content you accessed, and features you used on our Service.
Geolocation data: with your consent, the Service may access precise geolocation data on your mobile device to enable features and deliver content based on your current location.

The app include social features letting users connect, compete and compare statistics. For a connection to be made, the app uses an invite system requiring both the inviter and the invitee to take action for a connection to be made. It is at all times the guardians responsibility to make sure kids don't befriend strangers without supervision.
The service also has a map function that allows parents to locate their children when they are out and about with the Smart Micro Egg. The tracking is done via the smartphone and not via the Smart Micro Egg. No geolocation data is stored on the Smart Micro Egg. Tracking is only possible between members of a registered user account and can be disabled at any time via the parent dashboard. In addition, Micro may also collect information and store it locally on your device smartphone by using mechanisms such as App Data Caches.

How we collect information:

When using our Service we collect personal information from all registered users such as email address and usage data.

Why we collect personal information:

1. We collect Non-personal and Personal Information for the following purposes:

To operate, improve, and develop our Service;
Provide you with personalized recommendations for Micro products and/or features;
Populate online leaderboards and enable online matchmaking;
Serve and measure the effectiveness of advertising;
Measure the health of our services;
Set up and maintain accounts you register for;
Provide game experiences that you may like;
Set up loyalty programs;
Facilitate your gameplay on multiple devices when available;
Identify, fix, and troubleshoot bugs and service errors;
Provide software updates;
Activate or authenticate your games and save game progress and stats;
Run competitions and contests;
Adhere to your preferences and to deliver dynamic content; and
Help keep our services safe and fair, resolve disputes, investigate and help curb fraud and illegal behavior, comply with the law, and to enforce our agreements and policies.
To comply with any applicable laws and regulations.

2. To provide you support, including to:

Help identify and troubleshoot problems with your account or games;
Survey your opinions through surveys or questionnaires;
Communicate with you and respond to your specific requests or questions;
Manage and send you confirmations and important information about your account, products, purchases, subscriptions, and warranties.

3. To personalize our communications with you, including to:

Present offers and/or information relating to Micro products you might like;
Make recommendations to you; and
Personalize advertising for you and deliver targeted marketing, service updates and promotional offers.

How we store, disclose and share your personal information:

Our Service is hosted on the Amazon Web Services platform which is managed by WRLDS Creations AB. Your data (e-mail address, nickname and usage data) may be stored through either platforms data storage, databases and general applications. They store your data on secure servers behind a firewall.
If you choose to opt in for the Micro newsletter, we will in addition store data about your email address.
We retain the information we collect for as long as necessary to provide our Service, and we may retain that information beyond that period if necessary for legal, operational or other legitimate reasons.

How we communicate with you as a visitor:

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.

How can you withdraw your consent?

If you don’t want us to process your data anymore, please contact us at support-smartegg@micro.ms.

Updates to the privacy policy

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website.
